This webinar will focus on responding to requests for non-beneficial treatment. California clinicians increasingly confront medical futility conflicts. Typically, in these disputes, the incapacitated patient’s legally authorized decision maker requests life-sustaining treatment that clinicians judge potentially inappropriate or non-beneficial. Most of these conflicts are resolved with mediation, transfer, or surrogate selection. For the subset that remain intractable, California laws provide a fair dispute resolution pathway that legally protects clinicians and hospitals who refuse to administer interventions determined medically ineffective or contrary to generally accepted healthcare standards.

Learning Objectives

As a result of attending this activity, the participants should be able to:

1. Explain how the California Probate Code authorizes clinicians and hospitals to withhold or withdraw life-sustaining treatment contrary to patient or surrogate direction when the requested treatment is medically ineffective or contrary to generally accepted health care standards.
2. Recognize that most medico-legal concerns about writing unilateral orders to withhold or withdraw treatment are misplaced and not evidence-based. California laws legally protect clinicians who follow specified dispute resolution procedures.
3. Describe widely recognized best practices for resolving disputes concerning medically ineffective or non-beneficial treatment (aka medical futility conflicts).
